Oktatás célja

In this course, students will learn about how EU law interacts with Member States’ legal orders. Specifically, they will study the rules and principles of applying EU law in national courts through interactive block lectures. Due to the decentralised application of Union law – and as a consequence of direct effect and primacy – national judges are required to directly apply EU norms in disputes before them. The principles established in judgments of the Court of Justice, in particular decisions delivered in preliminary ruling proceedings, serve as binding guidelines for the courts of the Member States in this regard. The course will enable students to gain an understanding of how EU law operates in practice and how it is relevant to national disputes and judicial procedures. Such knowledge is essential for any litigation law professional (magistrate, attorney or legal counsel) in all Member States. Five main topics will be discussed and analysed based on the Court of Justice case law: Application of EU law by national courts (Day 1) National procedural autonomy and its limits (Day 2) Preliminary ruling procedure (Day 3) Member State’s liability for breach of EU law (Day 4) Principle of effective judicial protection (Day 5)
