Learning outcomes
The course addresses the impacts of developments of technology and artificial intelligence in private law. Beyond general issues (fundamental rights, role of regulation) property law, contract law, liability in tort and sectoral issues (banking, finance, health care sector) are covered.
Course content
1. AI and Fundamental Rights – the landscape 2. Persons and assets in the digital age 3. Contract law: contracting via standard contract terms on the internet and digital services; the European legal environment 4. Formalities in contracts and wills 5. Self-driving cars and smart cities 6. The European approach; product liability and structural context of liability 7. Liability of online service providers (platforms in particular) 8. Smart contracts, cryptocurrencies and non-fungible tokens 9. Data and digital assets in property law 10. AI in health care sector 11. Data protection, AI and digitalization 12. Closing, conclusions and evaluation
Assessment method
Students are required to write an essay or to make an oral presentation on a topic chosen by them freely within the scope of the course, depending on the size of the group and as it would be arranged on the first class.
