- The aim of this introductory course is to compare the two main tracks of international dispute resolution: arbitration and litigation, and to explore the interface between them. The course is case-oriented and uses selected arbitral awards and court judgments to illustrate the legal issues presented.
- Course content
- The lectures will cover the following main topics: I. Arbitration - Advantages, disadvantages - Types of arbitration - Arbitral institutions - Investment arbitration, ICSID Arbitration agreement, arbitration clause, validity - specific issues Choice of law issues Enforcement of awards II. International Litigation - Jurisdiction - Enforcement of judgments - Arbitration and Litigation - Interaction
- Assessment method
- The course will conclude with an oral examination based on the lectures, materials and slides distributed.
