Introduction to the Hungarian Constitutional Law Syllabus The course intends to provide an overview on the basic principles and institutions of the Hungarian constitutional system. It is based mainly on legal sources of the Hungarian constitutional law, especially the decisions of the Constitutional Court, but deals with the problems in an international framework taking into account also the relevant international documents and case-law. Besides familiarizing students with basics of Hungarian constitutional law, the course reflects also on the current events in this field. Participants are required to occasionally read cases or documents before class in order to be able to engage in a discussion on the merits. At the end of the semester students shall write a short essay about a chosen topic of the course that contains a comparative part concerning their own legal system. The topics of the lessons are the following: Introductory lesson Constitution, constitutionalism Sources of Hungarian constitutional law The principle of popular sovereignty, direct democracy Representative democracy, elections The principle of the separation of powers, form of Government Overview of the main constitutional organs (Parliament, Government, President of the Republic) The rule of law, the role of the Constitutional Court and courts Fundamental rights and freedoms I. (General Overview) Fundamental rights and freedoms II. (Special aspects of some fundamental rights) Summary

INTRODUCTION TO HUNGARIAN CONSTITUTIONAL LAW Time: Thursday 14.00-15.30 Lecturers: Zoltán Pozsár-Szentmiklósy, Bernadete Somody and guest lecturers Contact: pozsarz@ajk.elte.hu E-learning: https://moodle4.elte.hu/ Course description and working method This course provides an introduction to the fundamental principles and institutions of the Hungarian constitutional system. While it is primarily based on the legal sources of Hungarian constitutional law, it also addresses issues in an international context, taking into account relevant international standards, as well as the regulations and practices of other countries. As well as familiarising students with the fundamentals of Hungarian constitutional law, the course reflects on current events in this field. Participants will be required to work in groups on readers and cases prior to class, in order to be able to engage in discussion about them. Course outline 19.02. Introduction 26.02. The Separation of Powers in practice (cases) 14.05. Presentation of the White Papers Materials Both readers and cases will be made available on the Moodle system. Requirements, assessment Active participation in classes Teamwork: elaborating a White Paper on a proposed reform related to a designated area of Hungarian Constitutional Law. The White Paper should present - the current state of regulation and practice in the field in question; - the challenges related to the functioning of the respective field; - a detailed proposal for reform that considers the planned legal and social impacts. The White Paper must be based on relevant internal and international legal sources, analyses, literature and data. The White Paper should be between 3,000 and 4,000 words long. White Papers must be presented by the team in class. - Evaluation criteria: relevant sources: 20%, analysing the background and context: 20%, structure and logic: 15%, cooperation: 15%, presentation: 30% - Deadline for uploading the White Papers and related presentations to Moodle: 10 May Assessment: - 81-100% grade (5) - 71-80% grade (4) - 61-70% grade (3) - 51-60% grade (2) - 0-50% grade (1)
